Historically, transgender individuals have largely been left out of the civil rights movements that have shaped our country’s employment discrimination laws.  In recent years, however, the EEOC has made clear that it interprets Title VII’s prohibition on sex discrimination to extend to gender identity and sexual orientation discrimination.  Similarly, since 2011, California’s Fair Employment and Housing Act has specifically included “gender identity” and “gender expression” as traits for which employees are protected from unlawful discrimination and harassment. In 2017, the California Fair Employment and Housing Council promulgated detailed regulations to clarify how protections based on gender identity and expression should be applied.  In addition, as social awareness grows, employers are likely to see an increase in transgender applicants, gender transitions by current employees, and lawsuits alleging gender identity discrimination. This program will provide an overview of the key terms and concepts; the evolving legal landscape; and compliance issues and approaches.
